No. For a Financial Agreement to be legally binding, both parties must receive independent legal advice from two different lawyers who must sign a certificate attaching to the agreement.
Yes, if it is not drafted correctly, such as if there was non-disclosure of assets, or if it was signed under duress. This is why using an experienced family lawyer is crucial.
It depends. Financial Agreements offer more privacy and flexibility (the court doesn’t review them), but Consent Orders are generally harder to overturn. We can advise which is best for you. Both are intended to provide finality, if properly done.
